All backing tracks are offered for license only. They remain the property of TRACKFISH.COM at all times. This is a licensing agreement and not a retail agreement. TRACKFISH.COM is licensed with MCPS and as such pays all appropriate royalties for recording of musical works into customised musical products. By accessing this site you agree, without exception, to all the terms and licensing conditions listed.

The license to use TRACKFISH.COM backing tracks as accompaniment to live performance is granted only to the named licensee. Use by third parties, lending, hiring or selling of the backing tracks is strictly prohibited. Breach of any/all of these conditions will revoke the license and render the user liable to legal action. No other rights are conferred by the license.

On receipt of payment for the license, copy (copies) of the backing track(s) will be supplied by either MP3 Download (via email), Audio CD or MiniDisc and mailed to the licensee by Royal Mail 1st Class in the UK, and AirMail Parcels internationally (for which a further additional charge will be made) . Orders by post will usually arrive within 2-3 working days (UK) or 7-8 days (International). Alternative delivery arrangements may be made by the licensee for which all charges must be borne by the licensee. Orders delivered by email will take a few hours. TRACKFISH.COM accepts no responsibility for losses or delays by the Royal Mail or any other delivery method selected by the licensee.

Once purchased the license cannot be cancelled by the licensee. For custom tracks (payment for services), once work has begun the payment cannot be refunded. Customers may not cancel any custom work that has commenced, although changes to the nature of the production are acceptable. Once a song is booked for production, we endeavour to deliver it within a mutually agreed time frame. We will not be responsible for any delays caused by factors that are beyond our control (e.g. power cuts, internet access problems with our ISP etc). No backing tracks may be returned for exchange or credit unless supplied in error by TRACKFISH.COM. In the event of a technical fault with the backing track, this must be reported within 7 days. TRACKFISH.COM will try to correct the problem within 7 days or, failing that, offer a full refund or supply an alternative track of the client’s choice.

This agreement is made in England and you agree that any dispute arising shall be governed by and construed in accordance with English law.

Refunds will be provided at the discretion of TRACKFISH.COM
